1. General Terms

You hereby certify that you are (i) over the age of eighteen (18) or have the legal ability to consent to use of this platform and avail its services and (ii) sound mind (iii) not legally disqualified by applicable laws of India to enter into this agreement (v) freely consenting to this agreement and (iv) You are located and agree to be bound by the laws Where We operate. You acknowledge that your ability to access and use the Service is conditioned upon the truthfulness of the information you provide to us.

These Terms constitute the entire Agreement between the Company and the User regarding the Service, and supersede and replace any prior agreements the User and the Company might have regarding the Service. The Company may revise these Terms from time to time and the same will be intimated to You. An opportunity to accept the modifications constituting binding agreement.

2. Description of the Content and Services

RPCLAN SERVICES PRIVATE LIMITED is a real estate company. The Company provides you with access to certain content concerning Company and its products and services, including descriptions, contact information, links, and other specialized content (collectively, the “Content“), as well as opportunities to contact Company or third parties, and other features and services. This Agreement applies to any products or services, including any real estate brokerage or ancillary services, offered, or provided to you by the Company (all of the foregoing, collectively with the Content, the “Services“). All new Content, Services, or features made available through the Site that were not made available as of the “Last Revised” date above, shall automatically become subject to this Agreement.

As part of the registration process for certain Services, you will be asked to select a username and password. We may refuse registration to anyone, and/or require additional information prior to accepting any registration, in our sole discretion. Furthermore, we may refuse to grant you a username that impersonates someone else, is or may be illegal, protected by trademark, vulgar, or offensive. You are responsible for maintaining the confidentiality of your username and password. If you believe your account is no longer secure, please notify us immediately at [support email].

3. Data

  • We use your personal information to fulfill our obligations to you to let or sell your property or to arrange viewings, obtain feedback, or contracts.
  • We conduct due diligence as per legal or regulatory obligations.
  • We share personal data with your agents and other agents as necessary to facilitate transactions.
  • We may share information with multi agents or developers.
  • We share personal data with third-party agencies for fraud prevention or money laundering checks.
  • We may refer your data for financing arrangements.
  • If we sell or merge our business, your details may be disclosed to new owners under similar data protection rules.
  • We share data with regulators, government bodies, law enforcement, and courts when required.
  • We use third-party service providers (e.g., IT contractors) for necessary operations.
  • We may share information internally on a need-to-know basis.
  • We may send marketing information about similar services; you can opt out at any time.

4. Acceptable Use

You agree not to use the Service in any unlawful or illegitimate manner or to contravene these terms. You shall not post, use, or transmit unlawful, defamatory, obscene, fraudulent, or harassing information or impersonate others. You shall not disrupt the Service through viruses, denial of service attacks, or other means. You must not attempt to gain unauthorized access to accounts, systems, or data.

The Platform and its apps may require updates from time to time. The Company may change, suspend, or discontinue services or features without prior notice.

5. Platform Intellectual Property

The Company owns or licenses all intellectual property rights in its Platform, content, and underlying source code. You may print or share limited content for personal use but not modify, reproduce, or use commercially without prior consent. Any breach will result in immediate termination of use rights.

6. Owner/Developer/Builder/Seller Representations and Warranties

  • All implied warranties are excluded.
  • We are not liable for loss of profits, business, or indirect damages from use or reliance on Platform content.
  • We are not liable for failure to execute contracts with property buyers.

7. Customer/Buyer Representations and Warranties

  • The Platform is for domestic, personal use only; no liability for commercial loss.
  • We are not liable for issues with third-party links, products, or services.

8. Subscriptions and Payment

Subscriptions may renew automatically unless canceled. You authorize charges to your selected payment method for ongoing subscription fees. Refund timelines may vary due to multiple institutions involved in processing.

9. RERA Disclaimer for Customers

The Platform aligns with RERA guidelines and may include indicative content. Customers must independently verify all project details and avoid relying solely on online listings.

10. Property Viewing

Buyers are responsible for all property inspections and verifications before making offers. The Platform lists properties “AS IS,” and the Company is not liable for inspection-related issues or claims.

11. Role of Intermediary

The Company acts as a facilitator between agents, buyers, and sellers. It does not act as an agent for any party.

12. Linking

You may link to our homepage fairly and legally but must not suggest any false association or endorsement. Framing our site or linking to subpages requires prior written consent.

15. Indemnification

The User shall indemnify and hold harmless the Company and its affiliates, subsidiaries, directors, officers, employees, and agents against all claims, damages, and liabilities arising from your use of the platform or breach of this agreement.

16–25. Other Legal Clauses

  • Terms remain valid as long as you use the Platform.
  • The relationship does not create any partnership or agency.
  • If any clause is invalid, others remain enforceable.
  • Notices shall be sent in writing or email and deemed received when transmitted.
  • All parties must comply with Indian laws. Disputes are subject to Bengaluru jurisdiction.
  • Third-party content or advertisements are the responsibility of those third parties; we disclaim liability.
  • Users must bring claims within one year. Inappropriate messages may be removed.
  • Users must not use the Platform for spam or unsolicited emails. We may block such activity.
  • Users have the right to non-discriminatory access to listings.
  • Complaints or concerns should be addressed to the designated Grievance Officer via written communication.

COMPANY USES ALL REASONABLE EFFORTS TO ENSURE INFORMATION IS ACCURATE BUT MAKES NO WARRANTIES OF COMPLETENESS OR ERROR-FREE OPERATION.
